Ambrosia ‘We Will Pay Your Builder Deposit Up To $35K’ Campaign Terms & Conditions

  1. These terms and conditions have been developed by St.Leonards Property Holdings Pty Ltd (SPH) who are the owners and developers of Ambrosia Kyneton.
  2. SPH is running a promotion offering purchasers of lots in Ambrosia Kyneton up to $35,000 (Incentive Payment) towards their builder’s deposit (Promotion).
  3. The Promotion runs from 9am (AEDST) on Saturday 23 rd November 2024 and ends at 5pm (AEDST) on Friday 28 th February 2025 or such later date notified by SPH by providing at least fourteen days' notice on www.ambrosiaestate.com.au (Promotion Period).
  4. The Promotion applies to residential lots at Ambrosia Estate Kyneton.
  5. The Promotion is available to any purchaser who, during the Promotion Period, enters into a contract (Land Contract) with SPH for the purchase of a residential lot at Ambrosia and who subsequently settles that lot.
  6. A special condition contained in the Land Contract will be the mechanism by which the promotion becomes legally binding on the parties.
  7. The special condition will require that the Incentive Payment is paid at settlement to either the purchaser’s nominated builder towards the deposit payable under the building contract (Deposit Option), or as a rebate to the purchaser on the land purchase price (Rebate Option), at the purchaser’s option.
  8. If the purchaser chooses the Deposit Option, the amount of the Incentive Payment will be 5% of the building contract price up to a maximum of $35,000.
  9. If the purchaser chooses the Rebate Option the Incentive Payment will be $35,000.
  10. For the avoidance of doubt, Purchasers will be required to pay the full deposit under the Land Contract.
  11. SPH reserves the right to cancel, extend or make changes to the Promotion at any time.
  12. SPH reserves the right to withdraw any individual residential lots at Ambrosia Estate from the Promotion at any time.
  13. A payment of the builder’s deposit by SPH does not constitute any approval or acceptance of the building design against the Ambrosia Estate Design Guidelines.
  14. SPH gives no warranties and makes no representations about any builder's ability to enter into or perform a building contract, and the Purchaser accepts that they bear the risk of any builder becoming insolvent prior to or during the construction of a dwelling on the lot they purchase. The Purchaser agrees that they will not make any claim against SPH regarding these matters.
  15. f a Purchaser pays any form of commitment fee or initial deposit to a Builder, the treatment of that payment is a matter between the Purchaser and the Builder only.
  16. SPH will not be liable for any liability, loss, damage or expense (including but not limited to direct, indirect or consequential loss or loss of profits), or death or personal injury, suffered or incurred (whether or not arising from any person's negligence) arising out of or in connection with this Promotion or a building contract (including any failure by a builder to enter into or perform a building contract), except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
  17. These terms and conditions are governed by and are to be construed in accordance with the laws of Victoria.
  18. If any part of these terms and conditions is found to be invalid by law, that part is severed and the rest of them remain valid and enforceable.
